The court has given the Kenya Kwanza government the final call to produce proof of the cancellation of the tenders awarded to the Adani Group by KETRACO, until August 1.
According to a report by Citizen Digital, the matter before Justice Bahati Mwamuye on June, Tuesday 10, the court has been informed that the government had not filed the proof of cancellation, as respondents requested additional time to submit their responses.
“The respondents, specifically the first respondent , are granted a final opportunity to file and serve their responses to the application and petition. They must do so by August 1 this year,” directed the court.
Mwamuye further directed that if the Kenya Kwanza government through the Attorney General (AG) fails to file the required documents by the stated deadline, the case will proceed to a full hearing session. The court directed that the matter will be mentioned on October, 27, 2025 as a direction of a joinder of parties will be issued.
The cancellation of the Adani deals in the renovation of the Jomo Kenyatta International Airport (JKIA), and KETRACO, followed an uproar from members of the public both on the street and online, rejecting the 30-year deal between the government and the Indian based company. The whistler blower Nelson Amenya stated that the government was planning to lease the airport.
During his state of the nation address in November, President William Ruto ordered the ministries of Public Transport and Energy to cancel the JKIA and KETRACO deals with Adani Group with immediate effect. However, earlier the High Court had issued a conservatory order suspending the implementation of the agreement.
Further faulting the deal was the Law Society of Kenya (LSK), which argued that the deal failed to factor in proper public participation, as well as violating the Kenyan Constitution that requires openness, transparency, accountability and fiscal responsibility.
