Kennedy Kalombotole the main suspect in the murder of Gilbert Kinyua in February and Edward Maingi on July, Thursday 17 at Kenyatta National Hospital (KNH), was arraigned at the Kibera Law Courts on Monday 21.
The Court directed that Kalombotole medical reports done KNH and Nairobi Women’s Hospital be submitted to the County on July, Thursday 24, before a ruling is delivered.
Kalombotole a long term patient at KNH will remain in custody at Kilimani Police Station, after Magistrate Daisy Mutai declined a plea by his lawyer, Zephaniah Achapa, to have him hospitalized.
Achapa told the Kibera Law Courts that his client suffers from diabetes and high blood pressure and needs specialized care at Kenyatta National Hospital. The court has ordered medical reports from both KNH and Nairobi Women’s Hospital before making a final decision.
“We have been informed that he is still receiving treatment, he will still be held at the Kilimani police Station as he receives that treatment that he has been receiving until further orders from the Court,” Mutai directed.
The Office of the Director of Public Prosecutions (ODPP) had requested for police to hold the suspect for 21 days pending the completion of investigations into the case.
The Persecution team arguing before the Court stated that if the suspect is released, he might interfere with the investigation and key witnesses in the case.
“We are requesting for 21 days as the respondent has been a patient at KNH and currently has no place of abode. If released, he is likely to abscond, and we will not be able to trace him,” they argued.
They further argued that they need a secure place to hold the suspect, following his mental history and previous incidents linked to him at KNH.
We are also apprehensive of his mental state, as he is believed to have been involved in several incidents at Kenyatta National Hospital. We require a secure facility to hold him, considering he has been identified as a person of interest in two murder cases,” they further argued.
Kalombolote was arrested by homicide detectives after they detected slippers in his room as well as bedsheets stained with blood, after he allegedly slit the throat of Maingi in Ward 7B, where he is also believed to have murdered Kinyua in the same manner.
