Trans Nzoia county governor George Natembeya finds relief after High Court Temporarily stops criminal prosecution charges against him by the Ethics and Anti-Corruption Commission (EACC).
In the statement issued by High Court Judge Justice Bahati Mwamuye, the Court has issued conservatory orders against the prosecutors, directing the court serve the petition, application and accompanying orders to be served to all respondents including the Director of Criminal Investigation (DCI), and Director of Public Prosecution (DPP).
“Pending the inter parties hearing and determination of the petitioner/Applicant’s Notice of Motion Application dated 05/06/2025, a conservatory order be and is hereby issued staying the criminal investigation proceedings in Nairobi Milimani Chief Magistrates Anti-Corruption Case Number E024of 2025 Republic-v- George Natembeya and Anor,” read the statement.
The statement further directed the court compliances with the mention on 30/06/2025, on the hearing and determination of the Application and petition.
Natembeya moved to court seeking to stop his prosecution, citing constitutional violations, and linking his accusations to settling of political scores, following his calls on respect of Luhya unity and delivery of services by Kenya Kwanza government to Kenyans.
According to EACC, Natembeya is accused of irregular offering of tender in the county’s key projects, with construction of phase two of Kenyatta Stadium and ongoing construction of the County Headquarters, as well as the Tom Mboya Mother Baby Hospital.
Natembeya’s Milimani home in Kitale, and Nairobi were raided by officers from the EACC, in search of evidence. Following the case, he was barred from accessing his Kitale Town main office, until 60 days of investigation are concluded.
The vocal governor moved his office to Kiminini Constituency, where he said county operations are ongoing, and that office of the governor is not a building but service. He further stated that the move will help him interact and understand the challenges of residents in rural areas of Trans Nzoia.
